Introduction
Welcome to CypArch. These Terms of Service ("Terms") govern your access to and use of the CypArch website, mobile applications, and services, including any content, functionality, and services offered on or through our website or mobile applications (collectively, the "Services").
Please read these Terms carefully before you start to use the Services. By using the Services, you accept and agree to be bound and abide by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Services.
The Services are offered and available to users who are 18 years of age or older. By using the Services, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.
1. Definitions
- "Agreement" means these Terms of Service.
- "Content" means text, graphics, images, music, software, audio, video, information or other materials.
- "Course(s)" means the educational programs offered by CypArch.
- "Intellectual Property Rights" means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights.
- "Materials" means any Content that CypArch makes available through the Services, including but not limited to videos, lectures, course materials, assignments, and assessments.
- "Student" means a registered user of the Services who has enrolled in a Course.
- "Student Content" means Content that a Student posts, uploads, publishes, submits, or transmits to be made available through the Services, including assignments, projects, and forum discussions.
- "User" means a person who accesses or uses the Services.
2. Accounts
In order to access most features of the Services, you must register for an account. When you register for an account, you may be required to provide us with some information about yourself, such as your email address or other contact information. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times.
You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to immediately notify CypArch of any unauthorized use of your account or any other breach of security.
CypArch cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
3. Course Enrollment and Payment
CypArch offers various Courses on the Services. By enrolling in a Course, you agree to pay the specified fees for that Course. All fees are in Euros and are non-refundable except as provided in our Refund Policy below.
Payment for Courses must be made using the payment methods specified on the Services. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your purchase (including any applicable taxes and other charges).
Course fees may change at any time, but changes will not apply to Courses for which you have already paid. We reserve the right to offer promotional prices and discounts at our discretion.
Refund Policy
If you are not satisfied with a Course, you may request a refund within 14 days of enrollment, provided you have not completed more than 20% of the Course. To request a refund, please contact us through the contact form on our website.
CypArch reserves the right to refuse a refund request if we determine, in our sole discretion, that the request is fraudulent, violates these Terms, or is otherwise suspicious.
4. Course Access and Participation
Upon successful enrollment and payment, you will be granted access to the enrolled Course for the duration specified during enrollment. Some Courses may have specific start and end dates, while others may be self-paced or offer lifetime access.
CypArch reserves the right to modify, update, or discontinue any Course or portion thereof at any time. If a Course you have paid for is substantially modified or discontinued before its scheduled completion, we will provide you with reasonable advance notice and, at our discretion, either (a) provide you with access to an updated or comparable Course at no additional cost or (b) issue a prorated refund for the unused portion of the Course.
As a Student, you are expected to participate in Courses in accordance with our Code of Conduct, which includes but is not limited to:
- Respecting the intellectual property rights of CypArch and others;
- Submitting only your own original work for assignments and assessments;
- Treating instructors and fellow Students with respect in forums, discussions, and other interactive spaces;
- Refraining from sharing your account credentials or Course access with others; and
- Using the Services in compliance with all applicable laws and regulations.
Violation of these participation guidelines may result in, among other things, removal from Courses, loss of access to the Services, and/or termination of your account.
5. Intellectual Property Rights
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by CypArch, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Subject to your compliance with these Terms, CypArch grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and Materials solely for your personal, non-commercial educational purposes. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:
- Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
- You may store files that are automatically cached by your web browser for display enhancement purposes.
- You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
- If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
You must not:
- Modify copies of any materials from the Services.
- Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
- Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services.
- Access or use for any commercial purposes any part of the Services or any services or materials available through the Services.
If you wish to make any use of material on the Services other than that set out in this section, please address your request to the contact information provided on our website.
6. Student Content
The Services may allow Users to create, post, upload, share, or store Student Content. You retain all rights in, and are solely responsible for, the Student Content you post to the Services.
By creating, posting, uploading, sharing, or storing Student Content on or through the Services, you grant CypArch a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, copy, modify, reproduce, distribute, prepare derivative works of, display, and perform the Student Content in connection with the Services and CypArch's business, including without limitation for promoting and redistributing part or all of the Services in any media formats and through any media channels.
You represent and warrant that:
- You own the Student Content or have the right to use it and grant us the rights and license as provided in these Terms.
- The Student Content does not infringe, misappropriate, or violate a third party's intellectual property rights, or rights of publicity or privacy.
- The Student Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
- The Student Content does not promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- The Student Content does not violate any applicable law, regulation, or rule.
CypArch reserves the right to remove any Student Content from the Services at any time, for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Student Content), or for no reason at all. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of CypArch, its users and the public.
7. Prohibited Uses
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate CypArch, a CypArch employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm CypArch or users of the Services or expose them to liability.
Additionally, you agree not to:
- Use the Services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Services.
- Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose, including monitoring or copying any of the material on the Services.
- Use any manual process to monitor or copy any of the material on the Services or for any other unauthorized purpose without our prior written consent.
- Use any device, software, or routine that interferes with the proper working of the Services.
- Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services.
- Attack the Services via a denial-of-service attack or a distributed denial-of-service attack.
- Otherwise attempt to interfere with the proper working of the Services.
8. Termination
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.
If you wish to terminate your account, you may simply discontinue using the Services, or contact us using the contact information provided on the Services. Notwithstanding any provision of these Terms, we reserve the right to maintain, delete, or destroy all communications and materials posted or uploaded to the Services pursuant to our internal record retention and/or content destruction policies.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Disclaimer of Warranties
THE SERVICES AND ALL CONTENT AND MATERIALS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER CYPARCH NOR ANY PERSON ASSOCIATED WITH CYPARCH MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.
WITHOUT LIMITING THE FOREGOING, NEITHER CYPARCH NOR ANYONE ASSOCIATED WITH CYPARCH REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY CONTENT OR MATERIALS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES OR ANY CONTENT OR MATERIALS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
CYPARCH HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
10. Limitation of Liability
IN NO EVENT WILL CYPARCH, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
11. Indemnification
You agree to defend, indemnify, and hold harmless CypArch, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your Student Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.
12. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Cyprus without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of Cyprus, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
13. Changes to the Terms
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter.
Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
If we make material changes to these Terms, we will provide notice to you through the Services or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may close your account. Your continued use of the Services after we publish or send a notice about our changes to these Terms means that you are consenting to the updated Terms.
